The Lucknow Bench of the High Court has dismissed a PIL seeking an order to kill nuisance birds and animals, including stray dogs. The Court said that there is no such provision, which orders the Municipal Corporation to kill innocent animals.
This order was passed by the division bench of Justice Ramesh Sinha and Justice Subhash Vidyarti, rejecting the PIL filed by Manoj Kumar Dubey. The petition sought the eradication of nuisance and dangerous birds and animals, including stray dogs.
On behalf of the petitioner, it was said that the Municipal Corporation should be ordered to eliminate such animals. Dismissing the petition, the Court observed that there is no provision which mandates the Municipal Corporation to kill innocent animals. With these observations, the Court dismissed the petition.
